Student Intern Housing Agreement Terms and Conditions
This Agreement is for the Summer 2009 term. The residence service provided by this Agreement may not be sold, loaned, subleased, or transferred. This Agreement will not be accepted/processed unless the individual, hereinafter referred to as intern, is participating in an area internship or academic program. Written proof of internship or program is required.
A. This Housing License, hereinafter referred to as "Agreement", is between the individual named on the first page, hereinafter referred to as "Intern", and George Mason University.
B. OCCUPANCY OF RESIDENCE HALLS: Rooms may be occupied on Sunday, May 24, 2009 at 5:00 PM for the Summer 2009 term, unless otherwise specified by Housing. Rooms must be vacated on Saturday, August 1, 2009 by 5:00 PM for the Summer 2009 term. Interns must stay for a minimum of 30 nights.
C. RATES: FULL PAYMENT ON THE BALANCE OF STAY IS DUE PRIOR TO ISSUANCE OF ROOM KEY.
RATE AND PAYMENT INFORMATION: The rate is $29.00 per person/per night for single occupancy in a shared apartment. Payment of NONREFUNDABLE $203.00 DEPOSIT, which covers the first week (7 nights) occupancy, is required to process this Application/Agreement. Full payment of the remaining balance from said Date of Arrival to Date of Departure as listed on the front of this Application/Agreement is due prior to issuance of room key upon check-in. AMOUNT DUE IS PAYABLE TO GEORGE MASON UNIVERSITY BY CASHIER S CHECK, MONEY ORDER, CREDIT CARD (MASTER CARD or VISA only), or PERSONAL CHECK. All forms of payment may be made at the Office of Housing and Residence Life during business hours, Monday - Friday, 8:30 AM - 5:00 PM.
REQUESTS FOR ADDITIONAL STAY: Requests for additional stay must be submitted to the Office of Housing and Residence Life in writing at least five (5) business days prior to Date of Departure and will be granted on a space available basis. (Space is generally not available after 8/1/2009. Business days refer to Monday - Friday 8:30 AM - 5:00 PM only.) Failure to make payments as indicated will result in eviction.
REQUESTS FOR REFUNDS: Requests for refunds for departure prior to Date of Departure must be received by the Office of Housing and Residence Life in writing ten (10) business days or more prior to the requested new date of departure. Refunds for early checkout nine (9) business days or less prior to said Date of Departure will not be granted. All refunds must be approved by the Office of Housing and Residence Life. If an intern does not check-in on the said Date of Arrival the Office of Housing and Residence Life will attempt to contact the intern to confirm his/her arrival. If the intern does not confirm his/her arrival, the reservation will be cancelled within 48 hours after said Date of Arrival. The $203.00 deposit is nonrefundable.
CANCELLATIONS: Cancellations must be received in writing 10 business days or more before Date of Arrival. The $203.00 deposit is nonrefundable. A valid credit card number is required and will be charged within five (5) business days after departure for the following: lost or un-returned key, additional cleaning required, residence hall damage, and outstanding housing charges. A statement of such charges will be mailed to the intern s permanent address as provided on the Application/Agreement.
ROOM ASSIGNMENTS/CHANGES: The Office of Housing & Residence Life has the sole right to make room assignments and room changes. This investiture reserves the right to discard or store at no liability for a limited period personal property remaining in an accommodation after the accommodation has been reassigned to another intern or is not vacated at the prescribed time. Every attempt will be made to honor requests, however, no guarantees can be made.
VACANCIES: The University reserves the right to consolidate or change room assignments, fill vacancies, and require an intern to move to different accommodations when the University deems it expedient, in which event the intern will be credited or charged the difference in room rate. Any behavior exhibited by an intern which intentionally shows neglect of another person s rights with the intent to acquire a private room or extra space is strictly prohibited and will result in eviction.
UNIVERSITY RIGHT OF ENTRY: The University reserves the right to enter and inspect the premises for housekeeping/maintenance/inventory purposes, to verify occupancy, to abate a public nuisance, and to protect interests related to the University s educational mission, or if there is reasonable cause to suspect activities which violate laws or university regulations. The University retains no liability of unproved claims for loss or damage from such necessary entrances. Advance notice will be given when possible.
KEYS: The room and/or exterior door key issued to the intern is the property of the University and cannot be exchanged, duplicated, or given to another person. An intern requiring a lock core change due to lost or missing keys will be assessed a $75 fee. A fee of $10 will be assessed for a lost, missing, or broken key card. Failure to return a key or key card at the end of the contract period will result in a charge to re-core the lock and make new keys.
LOCKOUTS: Interns who lock themselves out may borrow a temporary card up to three times at no charge. After a third lockout, fees will be charged at a rate of $10 for the fourth lockout, $15 for the fifth lockout, and $20 for the sixth lockout. For each subsequent lockout, a charge of $20 will be assessed.
RESIDENCE HALL DAMAGE: The intern is absolutely responsible for all damage done to the living/study areas and/or loss of any furnishing therein. In all cases the verified University assessment is conclusive. An intern may not cause damage to the property of the University or the property of others on the University premises. If the damage cannot be assigned to an individual or individuals, after reasonable investigation, administrative decision may be to assign the responsibility to the entire living unit. "I understand that I am jointly, with other residents, responsible for and may be charged my prorated share of the cost of whatever damage may occur from any cause, to the public or semiprivate areas in the residence complex." In all cases the University assessment is conclusive and verifiable by invoices processed and/or labor hours expended. All damage charge(s) which remain unpaid after the due date stated on the invoice may result in the cancellation of the current room accommodation and/or future consideration for housing accommodations and any other action deemed necessary for collection by the University.
ADDITIONAL CHARGES: A valid credit card number is required and will be charged within fifteen (15) business days after departure for the following: lost or unreturned keys, lockout fees, additional cleaning required, residence hall damage, and outstanding housing charges. A statement of such charges will be emailed to the intern s email account as provided on the Application/Agreement.
CHOICE OF LAW AND FORUM: All parties agree that this Agreement shall be construed, governed and interpreted pursuant to the laws of the Commonwealth of Virginia, and if any provisions of this agreement or parts thereof are held to be invalid under such law, the other such provisions or parts thereof will nevertheless continue in full force and effect. All disputes arising under this Agreement shall be brought before a proper state or federal court in the Commonwealth of Virginia.
COLLECTION: Failure to meet any financial obligation to the University may result in the delinquent account being placed with a collection agency, withholding of state tax refunds, legal action, and other collection procedures. The intern agrees to be responsible for all costs incurred by the University in collecting their delinquent account, including but not limited to, reasonable attorney s fees and court costs.
EXCLUSIONS: If for any reason occasioned by fire, strike, earthquake, accident, flood, riot, emergency, or natural disaster the University is unable to provide housing, the University has the right to cancel this Agreement with no liability to itself except for contracted commitments due prior to the date of cancellation. The University does not provide liability insurance for theft of or damage to the personal property of residents. Therefore, the University strongly encourages interns to purchase renters insurance.
RESIDENT STUDENT HANDBOOK: The intern shall comply with all University policies, rules and regulations including those in the Guide to Pride: Resident Student Handbook. These rules and regulations are made a part of this Agreement by reference. Interns should pay special attention to proper check-out procedures.
